1. Acceptance of These Terms
These Terms of Use (“Terms”) govern access to and use of WriteLeap (the “Service”), which is provided by FOVA Pty Ltd (ABN 68 690 003 804) (“we”, “our” or “us”).
By creating an account, purchasing or starting a subscription or trial, allowing a student to use the Service, or otherwise using WriteLeap, you agree to these Terms and our Privacy Policy.
If you accept these Terms on behalf of a child, family, school or other organisation, you represent that you have authority to do so. If you do not agree to these Terms, do not use the Service.
2. Description of WriteLeap
WriteLeap is an adaptive English writing-practice system designed primarily for Australian students in Years 3–10. Features may include diagnostic writing, weekly writing tasks, skill exercises, writing prompts, mechanics checks, AI-assisted feedback, revision activities, scoring information, skill and level estimates, progress tracking and personalised practice plans.
WriteLeap may support classroom writing and preparation for writing tasks relevant to NAPLAN, selective-school preparation, scholarship or HAST-style assessments, general school writing and extension practice.
Unless expressly stated otherwise, WriteLeap is an independent educational technology service. It is not affiliated with or endorsed by ACARA, a state education department, a selective-school authority, HAST, a scholarship provider, a school or any examination body. WriteLeap does not issue official school grades, admission decisions or credentials.
3. Eligibility and Use by Children
WriteLeap is intended to be used by children and teenagers with appropriate adult involvement. The person purchasing a subscription or creating a parent-managed account must be legally capable of entering into these Terms.
If a student is below the age at which they may independently agree to these Terms or relevant data processing under applicable law, the Service may be used only with the permission and supervision of a parent, legal guardian, school or other authorised adult as required.
Parents and guardians are responsible for deciding whether the Service is appropriate for the child, supervising use where appropriate, and helping the child avoid including unnecessary sensitive personal information in writing submissions.
4. Accounts and Student Profiles
You must provide accurate information reasonably required to create and maintain your account and any student profile. You are responsible for keeping login credentials confidential and for activity occurring through your account, except to the extent caused by our failure to meet a non-excludable legal obligation.
You must not create or manage a student profile for a child unless you are authorised to do so. You must notify us promptly if you reasonably believe an account has been accessed without authorisation.
We may support third-party sign-in methods, such as Google sign-in. Use of a third-party sign-in provider is also subject to that provider’s applicable terms and privacy practices.
5. Student Content and Attempts
Students may submit writing, exercise answers, revisions and other material (“Student Content”). The Service may retain multiple attempts so that first drafts, revised drafts, repeated practice and progress can be reviewed.
You retain ownership of original Student Content, subject to any rights held by third parties in materials included in a submission. You grant us a limited, non-exclusive licence to host, copy, process, transmit, analyse and display Student Content only as reasonably necessary to operate, secure, support and improve the Service as described in these Terms and our Privacy Policy.
You represent that you have the rights and permissions reasonably necessary to submit Student Content. Students should not intentionally submit passwords, payment details, government identifiers or other highly sensitive information that is not required by the task.
6. AI-Assisted Feedback and Automated Assessment
WriteLeap uses automated systems, including artificial intelligence (“AI”) and predefined scoring or progression rules, to analyse student writing and provide educational feedback. Depending on the activity, automated processing may contribute to feedback, mechanics checks, revision suggestions, scoring information, skill observations, level estimates and recommended practice.
Some AI processing may be performed by third-party AI and language-processing service providers acting on our behalf. WriteLeap may also apply its own rules to validate, combine, calculate or limit AI-generated results before they are displayed or used for progress tracking.
Automated outputs may influence the feedback, skill profile, recommended difficulty or personalised practice plan shown within WriteLeap. They do not determine official school grades, school admission, selective-school results, scholarship awards or other official or high-stakes educational outcomes.
You should use automated feedback as part of the learning and revision process rather than treat it as a definitive assessment. No high-stakes educational decision should be made solely on the basis of a WriteLeap score, level estimate or AI-generated output.
Our Privacy Policy explains what information may be processed by third-party AI service providers, how we seek to minimise identifying information included in AI requests, and how student writing and personal information are handled in relation to AI model training.
7. Academic Integrity
WriteLeap is designed to improve a student’s own writing through practice, feedback and revision. It is not intended to help students misrepresent AI-generated work as their own or evade the academic-integrity rules of a school, examination provider or other institution.
You agree not to use WriteLeap to:
- commit plagiarism, cheating or other academic misconduct;
- submit AI-generated or substantially AI-rewritten text as a student’s original assessed work where that is prohibited;
- misrepresent WriteLeap feedback, sample language or model content as original student work; or
- circumvent supervision, exam or assessment rules.
Students should use feedback to understand weaknesses and revise their own work. Parents, guardians and teachers should supervise use where appropriate to support genuine learning.
8. Educational Results and Exam Preparation
WriteLeap may estimate a student’s current writing level, track skill development and provide practice aligned with selected educational goals. These are internal educational indicators, not official results.
We do not guarantee any particular school grade, NAPLAN result, selective-school outcome, scholarship result, HAST result, admission decision, improvement rate or other educational outcome. Results depend on many factors outside our control, including the student’s effort, prior knowledge, teaching environment, assessment conditions and the criteria used by the relevant institution.
Assessment formats, rubrics and official requirements can change. Users remain responsible for checking current official requirements where a specific examination or admission process matters.
9. Licence and Service Restrictions
Subject to compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable licence to access and use WriteLeap for ordinary educational and family use, or for organisational use where separately authorised.
No rights are granted except those expressly stated. You may not copy, sell, sublicense, distribute, reproduce or commercially exploit substantial parts of WriteLeap, its task bank, software, scoring logic, interface, content or data except with our written permission or as permitted by law.
10. Acceptable Use
You must not:
- use the Service for unlawful, fraudulent, abusive or harmful purposes;
- infringe intellectual-property, privacy or other rights of another person;
- attempt to reverse-engineer, decompile, extract source code, scrape or systematically copy the Service except where law expressly permits it;
- use bots, scripts or automated tools to access the Service at scale without permission;
- attempt to bypass usage limits, subscription controls, authentication or security measures;
- introduce malware, overload infrastructure, probe vulnerabilities or interfere with operation of the Service;
- share credentials in a way that permits unauthorised account use; or
- use the Service to generate or distribute content that is unlawful or intentionally harmful to children.
We may investigate suspected misuse and take reasonable action, including limiting access or suspending an account.
11. Subscriptions, Trials, Billing and Cancellation
WriteLeap may offer free access, free trials and paid subscription plans. The price, billing interval, included features, trial period (if any), currency and other purchase details are shown at checkout and form part of these Terms.
Unless the checkout page states otherwise, paid subscriptions are billed in advance on a recurring monthly or annual basis. If a free trial converts automatically into a paid subscription, the checkout flow will disclose the trial period and the price that applies when the trial ends.
Automatic renewal: unless you cancel before the applicable renewal time, your subscription may renew automatically for the next billing period and the payment method on file may be charged the then-applicable subscription price.
You may cancel an eligible subscription through the account/subscription management function or another cancellation method we make available. Unless applicable law or the purchase terms require otherwise, cancellation stops future renewal and does not automatically end access already paid for; access generally continues until the end of the current paid billing period.
If a payment fails, is reversed or remains unpaid, we may retry payment where permitted, restrict paid features, suspend membership access or cancel the affected subscription. We are not required to keep paid access active after the paid entitlement has expired.
We may change subscription pricing or plan features for future renewal periods. Where required by law, we will provide advance notice and an opportunity to cancel before a material price change takes effect.
12. Refunds and Consumer Rights
Except where required by law or expressly stated at checkout, subscription fees are not automatically refundable merely because a user changes their mind, does not use the Service or cancels after a renewal has occurred.
However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, refund right or other remedy that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law.
If you believe you are entitled to a refund or remedy, contact us with the account email and relevant transaction details. Payments made through a third-party platform may also be subject to that platform’s refund process.
13. Intellectual Property
You retain ownership of Student Content you create. Subject to that, all rights, title and interest in WriteLeap—including software, interfaces, design, branding, task-bank content, prompts created by us, instructional materials, scoring frameworks, databases, documentation and other proprietary materials—remain ours or our licensors’ property.
Feedback and reports generated specifically from a student’s submission may be used by the account holder for personal educational purposes. This does not transfer ownership of WriteLeap’s underlying systems, templates, rubrics, task bank or proprietary methodology.
14. Third-Party Services
WriteLeap may rely on or integrate with third-party services such as payment processors, hosting providers, email services, authentication providers and AI-processing services. Their services may be governed by their own terms and privacy policies.
Third-party services can experience outages, errors or policy changes outside our control. To the extent permitted by law, we are not responsible for an independent third party’s acts or omissions, but this does not limit any responsibility we have under non-excludable law for our own conduct.
15. Availability, Maintenance and Changes to the Service
We may update, improve, replace, add or remove features as WriteLeap develops. We may also conduct maintenance or temporarily limit access for security, reliability or operational reasons.
We do not guarantee that every feature will always be available, that the Service will be uninterrupted or error-free, or that historical features will remain unchanged. Where a material change significantly affects an active paid subscription, we will provide any notice or remedy required by applicable law.
16. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain and protect personal information, including student writing and learning data. The Privacy Policy forms part of the rules governing use of WriteLeap.
17. Suspension and Termination
You may stop using WriteLeap at any time. You may also request account deletion subject to the Privacy Policy and any information we are permitted or required to retain.
We may suspend, restrict or terminate access where reasonably necessary because of a material breach of these Terms, unlawful or harmful conduct, security risk, fraud, payment failure, abuse of the Service or a legal requirement.
Where reasonable and lawful, we may give notice and an opportunity to correct a breach before termination. Immediate action may be taken where necessary to protect users, children, the Service or third parties.
18. Disclaimers and Consumer Guarantees
To the maximum extent permitted by law, WriteLeap is provided on an “as available” basis and we do not promise that every automated result will be accurate, that the Service will always be uninterrupted, or that use of the Service will achieve a particular educational outcome.
WriteLeap is an educational support tool and does not replace qualified teachers, tutors, school assessment or professional educational judgment.
Nothing in these Terms excludes, restricts or modifies a right, guarantee or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
19. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from use of or inability to use WriteLeap, including loss of opportunity, loss of anticipated educational outcome or loss caused by reliance on an inaccurate automated output, where such liability can lawfully be excluded.
Where liability cannot be excluded but can lawfully be limited, our liability will be limited to the extent permitted by applicable law. Any monetary cap stated or implied by these Terms does not apply where such a cap would be unlawful or inconsistent with a non-excludable consumer guarantee or statutory right.
20. Responsibility for Misuse
You are responsible for losses reasonably arising from your unlawful use of the Service, intentional misuse, infringement of third-party rights, or material breach of these Terms, to the extent permitted by law.
Nothing in this section requires a consumer to indemnify us for loss caused by our negligence, breach of law or other conduct for which liability cannot lawfully be shifted to the user.
21. Governing Law and Disputes
These Terms are governed by the laws of Australia and, where relevant, the laws of the Australian State or Territory having the closest connection with the supply of the Service, together with any mandatory laws that apply based on your location.
If a dispute arises, please contact us first so we can try to resolve it informally. Nothing in these Terms prevents either party from exercising rights under consumer law, making a complaint to a regulator, or bringing a claim in a court or tribunal that has lawful jurisdiction.
22. Changes to These Terms
We may update these Terms to reflect changes in the Service, law, security requirements, payment arrangements or business operations. The revised Terms will state a new “Last updated” date.
If a change materially disadvantages an existing paid user during a current paid period, we will provide any advance notice, cancellation right or other remedy required by applicable law. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
23. General Terms
If any provision of these Terms is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. If we do not immediately enforce a provision, that does not waive our right to enforce it later.
Provisions that by their nature should continue after termination survive, including provisions relating to intellectual property, privacy, accrued payment obligations, misuse, liability and disputes.
These Terms, the Privacy Policy and any purchase terms shown at checkout form the agreement governing ordinary consumer use of WriteLeap. Separate written terms may apply to schools, tutoring organisations or enterprise customers.
